Severe loss to great ape habitat

Great apes, such as gorillas, chimps and bonobos, are running out of places to live, say scientists.

They have recorded a dramatic decline in the amount of habitat suitable for great apes, according to the first such survey across the African continent.

Eastern gorillas, the largest living primate, have lost more than half their habitat since the early 1990s.

Cross River gorillas, chimps and bonobos have also suffered significant losses, according to the study.

Details are published in the journal Diversity and Distributions.

"Several studies either on a site or country level indicated already that African ape populations are under enormous pressure and in decline," said Hjalmar Kuehl, of the Max Planck Institute for Evolutionary Anthropology in Leipzig, Germany, who helped organise the research.

But a wider perspective was missing; so various organisations and scientists joined to conduct the first continent-wide survey of suitable great ape habitat.

"Many of the authors have spent years to collect the data used in this study under extremely difficult conditions with a lot of personal commitment," Dr Kuehl told BBC Nature.

"Nothing comparable exists."

The scientists conducted the survey in two stages.

First, they determined the exact location of more than 15,000 sites where the various species and subspecies of African great ape have been confirmed living during the past twenty years.

"We then evaluated the environmental conditions at these locations and at all other locations across tropical Africa where great ape presence was not confirmed. This assessment included for instance percentage forest cover, human population density or climatic conditions," said Dr Kuehl.

From that the researchers could calculate the environmental conditions required for great apes to live. Then, using a statistical model, they predicted the amount of such habitat surviving across Africa, first for the 1990s, then the 2000s.

The results are grim reading for conservationists.

Gorillas have been significantly affected. Cross River gorillas have seen 59% of their habitat disappear over the past two decades. Eastern gorillas, the largest gorilla and largest surviving primate, have lost 52% of their habitat, while western gorillas have lost 31%.

The various species and subspecies of chimp have also suffered.

Bonobos, once known as pygmy chimpanzees, have lost 29% of their habitat. Of the different subspecies of common chimpanzee, those living in central Africa have lost 17% and those in western Africa 11% of their habitat respectively.

"From several site and country level studies we knew that pressure on great apes is increasing enormously. But despite these expectations it is outrageous to see how our closest living relatives and their habitats are disappearing," said Dr Kuehl.

The pressures on the great apes vary significantly depending on region.

For example, in western Africa, the loss of suitable habitat is being driven by forest clearance and hunting.

In Central Africa, huge swathes of pristine forest remain, but it is no longer suitable for great apes due to the extensive hunting that occurs within to supply the trade in bushmeat.

The scientists would like to improve their study, which provides a large scale picture of the habitat loss suffered by great apes, by including more local data.

Including socioeconomic data may help explain why apes still live in close proximity to people in some areas, while in most others they have disappeared.

"The situation is very dramatic, many of the ape populations we still find today will disappear in the near future," Dr Kuehl told BBC Nature. "In an increasingly crowding world with demand for space, wood, mineral resources and meat, apes will continue to disappear.

"Without a fundamental change in perception of how precious apes and their habitats are the current situation will not improve."

China hits back at Japan PM's statement on islands

BEIJING (AP) ? China on Thursday assailed Japan's prime minister as obstinate and wrong for saying his nation won't compromise in their island dispute, as Japanese lawmakers and business leaders visited Beijing with hopes of mending ties.

Relations between Japan and China are at their lowest in years because of their spat over the island group in the East China Sea known as Senkaku in Japan and Diaoyu in China. Japan says it bought the islands this month to thwart Japanese nationalists' more radical plans to develop them. But China saw the move as wrecking a prior arrangement with Tokyo, and it and many Chinese have responded with outrage.

Japanese Prime Minister Yoshihiko Noda said in New York on Wednesday that the islands are clearly an "inherent part of our territory, in light of history and international law." He said that issues over the islands should be resolved peacefully and by the rule of law.

In response, Foreign Ministry spokesman Qin Gang said Thursday that "China is strongly disappointed and sternly opposes the Japanese leader's obstinacy regarding his wrong position." His statement repeated China's stance that Japan was ignoring historical facts and international laws.

"The country seriously challenges the postwar international order, but tries to take the rules of international law as a cover. This is self-deceiving," Qin said in a separate statement.

Senior diplomats from the two countries have met this week in New York and Beijing in an attempt to patch things over. But China still scrapped long-planned festivities scheduled this weekend to mark 40 years of diplomatic relations between the countries.

Instead, Jia Qinglin, a senior Communist Party official, met with members of the China-Japan Friendship Association on Thursday. He struck a friendly note by welcoming the Japanese elder statesmen as "old friends of the Chinese people" who had worked hard to promote exchanges and cooperation in economic, political and cultural areas.

But in remarks released by the Foreign Ministry, Jia reiterated China's position on the island dispute, and said Japan's actions had "pushed China-Japan relations to an unprecedented grim phase."

Yohei Kono, a former Japanese foreign minister, referred to the strife when he told his Chinese hosts he had come to Beijing "this time with a heavy heart."

The islands, held by Japan, are tiny and uninhabited but sit astride rich fishing waters and potentially large reserves of natural gas. They are also claimed by Taiwan.

Japan's purchase of some of the islands from their private Japanese owners two weeks ago sparked sometimes-violent protests in China that targeted Japanese-owned stores and factories.

Noda defended the purchase as an attempt to ensure their "stable management," but conceded, "It seems that China has yet to understand that."

Parisian bookseller Michel Lepic is lost in a dreamworld, searching for a girl whose voice he once heard from the window of a seaside hotel. Memories such as his are priceless commodities in a place where vagrant, musician, housewife and sailor alike feed on borrowed recollections of other people's childhoods; where postmen peddle old letters and fortune-tellers read the past; where wine waiters serve generic vignettes of early courtship to amnesiac elderly couples; where only the tart wheeze of a bal-musette accordion triggers a sense of history and identity.

Premiered just a few weeks after the Anschluss, Bohuslav Martinu's 1938 opera, Julietta, is a more tender work than its Surrealist provenance and arch synopsis would suggest. Martinu had experimented with Dadaism in The Knife's Tears, but in adapting Georges Neveux's play, Juliette ou la cl? des songes, he found a more humane voice with which to explore the European unconscious. Nostalgia is the prettiest of?pretty lies, the sweetest of sweet-nothings. We are all dreamers in Julietta's peripheral, self-effacing soundworld of brushed strings, skittering xylophone, dewy celesta and knotted woodwind, struggling to pin down allusions ? now to Wagner, now to Dvorak, now to jazz, now to Brahms, now to Stravinsky ? before they melt away, leaving the faintest?impression.

Richard Jones's production for English National Opera offers an alluring realisation of Julietta in David Pountney's lip-smacking English translation (a feast of consonants for Martinu's elevated recitatives).

The piano accordion in the score looms large in Antony McDonald's glamorous designs: its keys and buttons stepping-stones for the dreamers; its bellows forming the hotel of Act I, the ship of Act II, and the vast files?of Act III's Central Bureau of?Dreams, where Jeffrey Lloyd-Roberts's harried Clerk rubber-stamps a fidgety Bell Boy's wish for a Wild West dream and a Convict's longing for a cell in which iron bars dissolve with a press of his little finger.

Julietta is ENO at its strongest, an off-beat, highly stylised ensemble-piece that plays to the strengths of company stalwarts and newer talents, most of them taking two or three roles. Among the first group, Henry Waddington's kindly Wine Waiter is the most touching, Susan Bickley's Fortune Teller the most chilling, staggering Cassandra-like with her hand clamped to her head. Among the second, Emilie Renard's bright, brilliant Arab Boy excels. Philippe Giraudeau's movement direction is bold, the crocodile "ballet" appropriately toothsome.

As Julietta, all nervous jiggles, vicious mocking and sudden seriousness, Julia Sporsen is dynamic, voluptuous and disturbing, while Peter Hoare's hapless Michel has kinetic energy and faultless diction, navigating Martinu's angular lines with tireless legato and a healthy tone, drawn inexorably back to his cruel fantasy mistress.

Edward Gardner conducts with a keen sense of pace, each colour and texture clear. If Martinu's melodies are forgettable, I suspect this is deliberate ? just another surreal joke in a strangely attractive, strangely sad opera, just another squeeze of the piano accordion in polyglot Paris.

Igor Toronyi-Lalic's exquisitely programmed Outsider Music Night for the Bold Tendencies sculpture project at a multistorey car park in Peckham, south-east London, pitched the wistful laments and blithe dances of the celebrated New York street musician Moondog against the crazed counterpoint of Conlon Nancarrow's Studies for Player Piano, James Tenney's Spectral Canon for Conlon Nancarrow and miniatures by Howard Skempton for piano and guitar. Performed by Dominic Murcott on a replica of Nancarrow's instrument, the blistered boogie-woogie and Goldbergian fragments of Canon X (from the late 1950s) sounded gorgeous in this cavernous concrete space. Most things do, it seems.

The audience was free to stand back, close in, sit down or wander at will, with minimal tension between those who had come for the music and those who had wandered down from the bar upstairs. In the central space, marimba-player Greta Eacott, drummer Jonathan Willoughby, cellist Kareem Dayes, melodica-player Emilio Reyes, charango-virtuoso Rudi Schmidt and double-bassist Joe Carvell provided the pulse of Moondog's "New Amsterdam" (1994) to three childlike soprano voices.

To one side, Toronyi-Lalic picked out the gentle, unresolved progressions of Skempton's Postlude (1978) and One for Molly (1972), to the other, Willoughby experimented with the dynamic range of a single tam-tam in Tenney's Postal Piece No 10: Having Never Written a Note for Percussion (1971). The instrumental standard was high, the audience bibulous but attentive.

South Sudan army sinks its own boat, killing 10

KAMPALA, Uganda (AP) ? An official says the South Sudanese military sank a boat carrying 170 of its own soldiers on the Nile river, killing at least 10, after mistaking them for enemy forces.

South Sudan army spokesman Col. Philip Aguer said Sunday that soldiers opened fire after the military vessel failed to respond to repeated calls for it to stop Monday night. Most of the soldiers managed to swim ashore, he said, but 50 are still missing.

Aguer said the South Sudanese government has launched an investigation into what happened, although he described the incident as "an accident."

Relations between South Sudan and Sudan have been marked by tension stemming from disagreements over their common border and how to share oil revenues.

The south became independent of the north last year.

Australia moves to ban trawler with 900-foot-long net

The world's second-largest fishing trawler, which can process 250 metric tons of fish a day using a 900-foot-long net,?will likely be banned by Australia for two years so that experts can study whether it would deplete fish stocks and worsen the accidental bycatch of sea turtles, dolphins and seabirds.

"There has never been a fishing vessel of this capacity in Australia before and the Environment Protection and Biodiversity Conservation Act needs to be updated so that it can deal with it," Environment Minister Tony Burke said before House lawmakers agreed to review the law and the science.?Australia's Senate is expected to take up a vote next week.

"When you have a vessel with a large freezer capacity that therefore is able to remain through extended periods of time in the same part of our oceans, there are a different set of environmental considerations," Burke said. "When the law falls short, you change the law."

The nearly 500-foot vessel, named the Abel Tasman, is registered in Australia and can hold up to 6,200 metric tons of fish.

Seafish Tasmania, an Australian company, brought the Abel Tasman to Australian shores last month in a joint-venture with the boat's Dutch owners. The venture had initially been awarded a quota to catch up to 18,000 metric tons of jack mackerel and red?bait fish under strict conditions.?


The partners and a commercial fishing group complained Australia was being unfair.

"Changing laws in response to emotive campaigning and 'trial by media' undermines the credibility of Australian fisheries management, creates uncertainty and insecurity for fishermen and deters investment that is needed to support regional jobs," Seafish Tasmania and the Commonwealth Fisheries Association (CFA) said in an open letter to lawmakers on Wednesday.

Greenpeace activists locked themselves to the anchorline of the Margiris on July 2 while it was still in the Dutch port of IJmuiden.

CFA spokesman Brian Jeffries said a counterargument could be made that large, strictly regulated trawlers are better than many small, less-regulated ones that "have to fish for much longer a period" and thus are "more likely to take, for example, bycatch."

Greenpeace, which had attempted to stop the ship from docking when it arrived in South Australia in late August, hailed the environment ministry's move as a "sensible response to the threat of the Abel Tasman."

The world's largest trawler is the Annelies Ilena, a slightly bigger Dutch ship that's now in the North Sea.?

Obama: 9/11 victims never to be forgotten

NEW YORK/WASHINGTON (Reuters) - The victims of September 11 will be remembered "no matter how many years pass," President Barack Obama said on Tuesday during one of three main ceremonies marking the 11th anniversary of the attacks in which nearly 3,000 people were killed by airliners hijacked by Islamist militants.

Two of the passenger jets brought down the Twin Towers of New York City's World Trade Center, another hit the Pentagon outside Washington and a fourth crashed in a field in Pennsylvania when passengers aboard that flight fought back against the hijackers.

Obama, speaking at the Pentagon where 184 people were killed, told victims' families that the whole country shares their loss.

"Eleven times we have paused in remembrance and reflection, in unity and in purpose," Obama said. "This is never an easy day, but it is especially difficult for all of you, the families of nearly 3,000 innocents who lost their lives.

"But no matter how many years pass, no matter how many times we come together on this hallowed ground, know this: That you will never be alone, your loved ones will never be forgotten. They will endure in the hearts of our nation because through their sacrifice they helped us make the America we are today, an America that has emerged even stronger."

Speaking under clear blue skies that recalled the crisp morning of September 11, 2001, Obama said America's fight is not with Islam but with al Qaeda, the group responsible for the attacks, and its allies.

It is a line he has used several times since taking office promising to mend ties with the Muslim world.

"I've always said our fight is with al Qaeda and its affiliates, not with Islam or any other religion," he said. "This country was built as a beacon of freedom and tolerance."

Before the Pentagon ceremony, Obama and first lady Michelle Obama observed a moment of silence on the South Lawn of the White House. Afterward they stopped at Arlington National Cemetery, where the two paid their respects at the graves of military service members killed in Iraq and Afghanistan.

Obama's rival for the White House, Republican presidential nominee Mitt Romney, said the anniversary marks a day "when evil descended upon our country."

"On this most somber day, those who would attack us should know that we are united as one in our determination to destroy them and to stand tall for peace and freedom at home and across the world," Romney said in a statement.

'THE PAIN IS SO DEEP'

At Ground Zero in New York where the towers once stood, hundreds of relatives of the victims were joined by local police, firefighters and politicians for the annual reading of the list of the 2,983 people killed at the three sites. The list excludes the 19 hijackers, who died carrying out the attacks.

Cora Fernandez, whose daughter, Judy Hazel Santillan Fernandez, and niece, Maria Theresa Concepcion Santillan, died at the trade center, stood with relatives wearing black T-shirts emblazoned with pictures of the two young women.

"The weather is so beautiful," Fernandez said, "but the pain is so deep. It'll always be there. It'll never go away."

Unlike previous years, politicians were barred from the podium for the name-reading ceremony, which took place alongside the twin reflecting pools that mark the footprints of the fallen towers, their edges etched with the names of the victims. Only families or close friends of the victims participated in the reading, which took more than three hours to complete.

Moments of silence were observed at 8:46 a.m. (1246 GMT), 9:03 a.m., 9:37 a.m. and 10:03 a.m., the times of impact for the four planes, and again at 9:59 a.m. and 10:28 a.m., the times that the north tower and then the south tower fell.

New York Mayor Michael Bloomberg and other politicians, including New York Governor Andrew Cuomo, New Jersey Governor Chris Christie and former New York Mayor Rudolf Giuliani, who was in office when the attacks occurred, gathered near the podium as the names were read.

Tuesday's ceremony occurred just hours after Bloomberg, Cuomo and Christie reached a deal to resume work on a National September 11 Museum at Ground Zero.

A cost dispute between the foundation that controls the museum and the Port Authority of New York and New Jersey, which is building it, has halted work on the underground structure for months.

This year's remembrance also came one day after federal officials agreed that the 70,000 surviving firefighters, police officers and other first responders who raced to the trade center after the attacks will be entitled to free monitoring and treatment for some 50 forms of cancer.

'THEY BARELY KNEW EACH OTHER'

In Shanksville, Pennsylvania, Vice President Joe Biden told families of the 40 passengers who died aboard United Airlines Flight 93 that the nation will always honor their heroism.

They fought back against their hijackers, a move that led to the plane crashing in a remote field 80 miles southwest of Pittsburgh. U.S. authorities say the hijackers planned to crash the plane into the U.S. Capitol in Washington.

Americans have "not forgotten the heroism of your husbands, wives, sons, daughters, mothers, fathers. And that what they did for this country is still etched in the minds of not only you, but millions of Americans, forever," Biden told a crowd of more than 1,000 gathered at the crash site, now a national memorial.

Patrick White, president of Families of Flight 93, said his cousin, Joey Nacke II, and the other passengers were mere strangers only moments before they made their assault on the cockpit where the hijackers had taken control.

"They barely knew each other," White said. "In an astoundingly brief period of time, they came together as one."

Also, see if he?s listening to you or if he?s just trying to get you to do what he envisions.

NASA Mars rover Curiosity's arm wields camera well

ScienceDaily (Sep. 11, 2012) ? NASA's Mars rover Curiosity stepped through activities on Sept. 7, 8 and 9 designed to check and characterize precision movements by the rover's robotic arm and use of tools on the arm.

The activities confirmed good health and usefulness of Mars Hand Lens Imager, or MAHLI, and used that camera to check arm placement during several positioning activities.

MAHLI took an image with its reclosable dust cover open for the first time on Mars, confirming sharp imaging capability that had been obscured by a thin film of dust on the cover during previous use of the camera. It took images of cameras at the top of Curiosity's mast, of the underbelly of the rover and of MAHLI's own calibration target, among other pointings.

"Wow, seeing these images after all the tremendous hard work that has gone into making them possible is a profoundly emotional moment," said MAHLI Principal Investigator Ken Edgett of Malin Space Science Systems, San Diego. "It is so exciting to see the camera returning beautiful, sharp images from Mars."

The camera's calibration target includes a 1909 Lincoln penny that Edgett purchased for this purpose. "We're seeing the penny in the foreground and, looking past it, a setting I'm sure the people who minted these coins never imagined," Edgett said.

The penny is a nod to geologists' tradition of placing a coin or other object of known scale as a size reference in close-up photographs of rocks, and it gives the public a familiar object for perceiving size easily when it will be viewed by MAHLI on Mars.

"The folks who drive the rover's arm and turret have taken a 220-pound arm through some very complex tai chi, to center a penny in an image that's only a few centimeters across," said MAHLI Deputy Principal Investigator Aileen Yingst of the Tucson-based Planetary Science Institute. "They make the impossible look easy."

The arm characterization activities, including more imaging by MAHLI, will continue for a few days before Curiosity resumes driving toward a mid-term science destination area called Glenelg. In that area, the rover may use its scoop to collect a soil sample, and later its drill to collect a sample of powder from inside a rock.

Curiosity is five weeks into a two-year prime mission on Mars. It will use 10 science instruments to assess whether the selected study area ever has offered environmental conditions favorable for microbial life. NASA's Jet Propulsion Laboratory, a division of the California Institute of Technology in Pasadena, Calif., manages the mission for NASA's Science Mission Directorate in Washington.

Harms of 'attorney driven' litigation shown in CLA, estate-planning ...

We know such companies exist and the public should aware of the threats they can pose.? We also, however, know that frivolous lawsuits occur and a Frisco, TX-based company, CLA USA and its affiliated CLA Estate Services and insurance services, says that?s exactly what happened to them.

For almost 30 years, Charles Loper Jr. has worked hard to build his financial planning service in Frisco, Texas, into an enterprise serving 40,000 customers in 38 states. But a lawsuit he calls ?frivolous? filed five years ago has threatened Loper?s success and the livelihood of his 350 employees.

In December 2007, three Texarkana residents filed a class action against a number of estate planning companies, alleging they were duped into buying useless living trusts. Among the companies named in the litigation were CLA USA and its affiliated CLA Estate Services and insurance services, even though the plaintiffs later admitted they had no idea why the CLA companies were even named in the suit.

After five years, Loper and CLA were voluntarily dismissed from the litigation, but damage had been done.

?This case has been a nightmare,? Loper told the Southeast Texas Record in a recent interview. ?We spend a lot of money to do things right, but this suit threw us in with those companies that don?t.?

Loper, who started CLA USA in 1984, said defending the suit has cost his companies $1 million, and ?untold millions in loss of customers? from bad publicity.

Olaf Turek, general counsel for CLA, said the company has been battling what he calls the ?attorney driven? litigation since 2007.

?Finally, after extensive discovery and being unable to find any facts to support the unfounded and malicious allegations, the plaintiffs dismissed their lawsuit on March 5, 2012,? Turek wrote in a letter submitted to the Record regarding the suit.

?In fact, it was acknowledged in depositions and admissions by certain class representatives that they never had any business dealings with any of the CLA entities and had no idea who CLA was or why they were included in the lawsuit. In fact, all class representatives had no idea why the attorneys were suing the CLA entities.?

The nightmare for Loper and his companies started on Dec. 19, 2007, when James Birts, Nate Orben and Darlene Orben filed a class action suit in the circuit court of Miller County, Ark., against several estate planning companies, like The Estate Plan. CLA companies, including CLA USA Inc. and CLA Estate Services Inc. were also named in the suit.

The original suit was filed by the Patton Roberts Law Firm, which Turek claims was known as a ?class action mill? in the Texarkana area. In addition, Turek said, Miller County is considered a ?very friendly? class action venue.

Turek said that because of the unfriendly venue and because the class included clients in both Arkansas and Texas, he was successful in moving the case to federal court, to the U.S. District Court for the Western District of Arkansas-Texarkana Division.

But after the transfer, Turek claims the plaintiffs were ?very slow? to initiate discovery, and turned the case over to its youngest and least experienced associates.

?Basically, this case became a training ground for the recently graduated associates,? he wrote.

According to Turek, the lawsuit included allegations regarding certain business practices that were identical to those of a company named The Estate Plan, based in Reno, Nev.

In 2005, the Supreme Court of Ohio found that The Estate Plan engaged in unauthorized practice of law by providing legal advice to customers without the use of a licensed, independent, legal professional.

The Estate Plan is in no way associated with any CLA entity and does not reflect the business practices of CLA, Turek said. Ultimately, the case against The Estate Plan was severed into a separate lawsuit.

During depositions, Turek said it became even more evident that ?this was purely an attorney-driven action.?

For example, in his deposition, when plaintiff Birts was asked whether he was aware of the complaints, he stated that he had no idea about them and had never seen the complaints.

?He provided no facts to support the allegations, and in fact, in September 2009, nearly two years after the lawsuit was filed, Birts signed a review form stating that he was satisfied with the services being provided by CLA,? according to Turek.

Turek states that more compelling evidence that this was an attorney-driven class action comes from the Orben plaintiffs.

?The Orbens were also not aware of the allegations about the CLA defendants,? he said. ?They said they had no idea why CLA was in the lawsuit and that they were unaware of any harm that CLA had caused them. The Orbens acknowledged in their depositions that they never had any business dealings with any of the CLA entities.

?Since Birts was satisfied with our services and since the Orbens never had any dealings with any CLA entities, CLA demanded that the plaintiffs? attorneys dismiss the class claims against the CLA defendants. After threatening them with sanctions, the plaintiffs? attorneys finally dismissed the claims against all CLA entities.?

Turek said the entire case was based on ?unfounded and unconfirmed facts.?

?This was purely a scheme to create a frivolous class action in order for the plaintiff firm to blackmail a settlement,? he said. ?We vigorously defended the case and in the end we were victorious in defending our practice.?

For Loper, the whole process has been a learning experience.

?It was eye-opening that anyone can say anything in a complaint based solely on assumptions and without any proof,? he said.

?But in the end, justice did prevail. We pride ourselves on providing excellent service to our clients and feel vindicated that this case was voluntarily dismissed without any finding of fault or settlement.?
